Letting Agent Registration Update

Anyone carrying out letting agency work in Scotland is required to join the Scottish Letting Agent Register.  It is a criminal offence for someone to carry out letting agency work if they aren't on the register, unless they submitted an application to the register by 1 October 2018 and it has yet to be determined.

Applicants to the Register are assessed to determine whether they are fit and proper persons to be carrying out letting agency work, including the extent to which they are complying withkey aspects of the Letting Agent Code of Practice.

To date the Scottish Government have received over 950 applications.  Of these, 870 applications have been approved so far, andwork continues to assess the remainder.  In addition, applications received from seven agents have been refused.  These agents are listed on the public Register:

Any landlord who has properties managed by any of these agents should immediately take steps to change to another agent.  Tenants of properties managed by any of these agents should contact their landlords to obtain information on alternative arrangements for rent payments and who to contact in the event of any issue with the property.

The Scottish Government is undertaking other compliance work and warning letters have been sent to over 100 businesses suspected of carrying out letting agency work in Scotland without being registered.

Agents who are registered should now be using their letting agent registration number on all their communications and advertising.  A search can be carried out on the Scottish Letting Agent Register using either this number, or the business name:
